Benjamin D. Salvina recently obtained a settlement over a National Labor Relations Board (NLRB) complaint filed on behalf of a former employee of Schott Pharma. Attorney Salvina argued that these non-disclosure and non-disparagement agreements were illegal. The NLRB agreed. Citing a February 2023 ruling entitled McLaren v. Macomb, the NLRB ruled that employers may not require employees to sign severance agreements that result in a broad waiver of rights guaranteed by the National Labor Relations Act. Attorney Salvina told local news outlet Lebtown, which provided news coverage of the decision, that “The board found that trying to suppress the speech of employees and former employees violated [the law].” Schott admitted to the alleged violations in a July 2023 settlement agreement. The NLRB settlement requires Schott to provide notice to current and former employees that the non-disclosure and non-disparagement provisions of severance packages are void. Salvina earned his undergraduate degree from Brown University and his law degree from the University of Pennsylvania Law School.
