Joseph D. Bernard is an attorney with over 20 years of experience in Massachusetts, specializing in OUI defense. He is known for his deep understanding of impairment science, forensic standards for breath and blood testing, and laboratory accuracy. He was lead defense counsel in a statewide litigation challenging breath test reliability, which led to an eight-year exclusion of breath test results due to misconduct by the Massachusetts Crime Laboratory. Bernard is the only lawyer in Massachusetts to complete the Robert F. Borkenstein courses in alcohol and drugs and has extensive training in gas chromatography and standardized field sobriety testing. He has received national recognition for Trial Advocacy in 2018, was named Lawyer of the Year in 2017 by Massachusetts Lawyers Weekly, and received the Kent B.
