The pedestrian was crossing the street at night, outside of a designated crosswalk, and wearing dark clothing when she was struck by a car that had the right of way. Client suffered severe injuries. Liability was initially denied. We successfully argued that the driver still has a duty to pay attention to his surroundings, and by documenting her injuries and their impact, we demonstrated that despite comparative fault, her damages justified a high value.
