Policy limit settlement for a fatal motorcycle crash where a vehicle violated right of way.

Our client was taking a leisurely ride on his motorcycle. He was travelling at 35 MPH, the speed limit in that area. All of a sudden and unexpectedly, a motor vehicle pulled out directly into his path, violating his right of way, and causing the front of his motorcycle to collide with the front right quarter panel of the motor vehicle. Our client was ejected from his bike, and died at the scene moments later. Attorney Brent Couture reached out to the insurance company to see if it would do the right thing given the obvious negligence on its insured and the unimaginable damages. However, its first reaction was to insinuate that our client was likely speeding and thereby caused or contributed to his own death. Couture Law P.A. hired one of the premier motorcycle crash reconstruction teams in Florida, purchased and stored the motorcycle for inspection and use at trial, and made arrangements to store and examine the defendant’s vehicle. Our crash team visited the site with some of the most advanced equipment available for accident reconstruction, including drone mapping of the entire crash site. Couture Law P.A. then hired a private investigator to search out and interview all possible witnesses to the crash. We were successful in finding a witness who was directly behind our client and could attest to the fact that our client was traveling at or below the speed limit and driving in a safe and reasonable manor. Our crash team pulled the data from the motorcycle and from the onboard computer inside the defendant’s vehicle. From this data, we were able to prove that the defendant’s vehicle pulled into the path of our client giving our client no time to react or avoid the collision in any way. Not long after we presented the insurance company with our overwhelming findings, they tendered the insurance policy limits of $2.5 Million (combined).
