Case Details

North Carolina Supreme Court affirmed the Business Court's decision in Crescent v. Trussway, clarifying the scope of North Carolina's economic loss rule in commercial construction. The ruling barred a commercial property owner from recovering purely economic losses in tort from a subcontractor with whom they had no contractual privity, even for defective materials.

Additional Notes

Christopher E. Faircloth authored an article detailing this case. Crescent's negligence claim for nearly $8 million against Trussway was rejected.
