Our client, a 57-year-old armored truck driver, suffered a significant brain injury, skull and neck fractures, and hydrocephalus after his vehicle hydroplaned on a poorly constructed highway during a heavy downpour, crashed into the median, and flipped. The North Carolina Department of Transportation found the road was poorly constructed, causing incorrect rainwater drainage and dangerous driving conditions. The settlement included a $3.25 million lump sum, a $2.4 million workers' comp lien waiver, and an agreement for lifetime medical care valued at approximately $4 million.

Additional Notes

A lawsuit was filed against the general contractor, the paving company, and the construction engineering inspection company for failure to construct the road according to plans, use proper paving techniques, and use proper inspection techniques. Allegations of employer negligence for failing to properly maintain the armored truck resulted in a substantial reduction in the workers’ compensation lien.
