Death in a Georgia long-term care facility (skilled nursing facility) caused by substandard care and neglect. Claims included allegations of Ordinary Negligence, Negligence Per Se, Wrongful Death, and violations of the Georgia Fair Business Practices Act (O.C.G.A. § 10-1-390), Unfair or Deceptive Practices Toward the Elderly Act (O.C.G.A. § 10-1-853), the Requirements for States and Long-Term Care Facilities (42 CFR § 483), and the Georgia Bill of Rights for Residents of Long Term Care Facilities (O.C.G.A. § 31-8-100 et seq). Punitive damages were imposed and compensatory damages were trebled by operation of law. The defendant was fined and jailed for 48 hours following the trial for contempt of court. In a subsequent criminal action, the defendant was sentenced to 20 years in prison for healthcare and tax fraud. Venue: Rome, Georgia.
