Laura Levenberg obtained a settlement on behalf of a 64-year old man who was injured when he fell down concrete steps while entering a residential home.

Ms. Levenberg faced an uphill battle as the steps in question were demolished prior to the client retaining Muller Brazil to represent him, and all defendants denying liability prior to filing suit. Although the incident occurred in Delaware County, the lawsuit was filed in Philadelphia County with allegations that the defendants (the owner of the property and the contractor working on the property at the time of Plaintiff’s fall) regularly conducted business in Philadelphia. Both defendants filed preliminary objections on the issue of venue, vehemently denying that they conducted business in Philadelphia and thus, venue was improper in Philadelphia County. Initially, the judge granted the defendants’ preliminary objections and transferred the case to Delaware County. However, Ms. Levenberg continued to aggressively litigate the issue of venue and filed a motion for reconsideration, arguing that one of the defendant’s cited that venue was improper under a Pennsylvania Rule of Civil Procedure that was inapplicable to this matter. Plaintiff's motion for reconsideration was granted, and the case remained in Philadelphia County. After the venue was decided, Ms. Levenberg was able to negotiate a large settlement for our client.
