Case Details

This case involved the negligent care of a three-month old’s respiratory illness which resulted in an arrest and failed intubation. Ultimately, the child suffered Hypoxic Ischemic Encephalopathy (HIE) of his brain as a result. Because of the doctor and nurse’s negligence the baby’s brain was damaged so badly he will never be able to function independently. The settlement money is intended to provide for the baby’s needs for life as well as compensate his parents for their loss of his companionship and affection. The settlement amount exceeds the maximum amount recoverable under the West Virginia Medical Malpractice Act, a disputed point of law in the case.
