Our middle aged client, a delivery driver for a utility, suffered serious neck injuries requiring cervical fusion surgery and was declared permanently disabled after a 6’ x 4’ foot side utility door weighing over 100 pounds detached from his box truck and struck him in the back of the head/neck.

The truck was owned by a “spin off” wholly owned subsidiary, allowing a lawsuit despite workers' compensation. Pre-trial discovery revealed the truck owner wrote specifications for an active T-bar latch system that was never installed, and neither the owner nor maintenance company inspected for compliance. The case settled after more than two days of mediation negotiations.
