Our client, a maintenance person, suffered a severe crush injury to his left foot, resulting in reflex sympathetic dystrophy and permanent non-weight bearing status, after an industrial scissors lift descended on his foot while he was attempting to brace a rolling bucket.

The case was tried on the theory that the scissors lift was unreasonably dangerous and defective due to a lack of 'telltales' to warn users of its descent and an on/off switch that allowed the operator to stand in a zone of danger. The case settled for $1,000,000.00 during jury deliberations. This was a 'third party workers compensation' case, allowing the client to recover damages beyond medical bills and lost wages from the lift manufacturer, including for loss of use of his foot and severe emotional distress.
