Case Details

A male waiter injured during the course of his employment when a piece of outdoor furniture fell from a 5-story roof deck that was under construction. The furniture fell to the ground and ricocheted up into the waiter's back, causing him to suffer a thoracic compression fracture.

Additional Notes

The matter proceeded to trial as the various property owners and furniture owners did not accept fault. On the eve of the trial, the furniture owner paid $250,000.00 to be released from the litigation. The case was then tried before a jury to reach a verdict against the non-settling parties. The jury rendered a $325,000.00 verdict. Due to the effect of the joint tortfeasor release, the plaintiff ended up being paid $445,000.00, which was $120,000.00 more than the actual verdict.
