Case Details

Jury verdict in Augusta County for the family of a 40-year-old mother of two who died from a misdiagnosed stroke. The emergency doctor diagnosed migraine, failed to consult a neurologist or use telestroke consultation, and ordered an MRI too late after the TPA window closed. The patient succumbed to brain stem herniation.

Additional Notes

The $3.5 million jury award was reduced to $2.15 million due to Virginia's medical malpractice damages cap. Attorneys representing the plaintiff were Frank Hilton, Tripp Franklin, and Alexandra Humphreys.
