Joe Terry obtained a $2,600,000 settlement for an Able-Bodied Jones Act Seaman who was injured while working on a third-party barge. Our client’s incident was not witnessed, nor did he immediately report his injury to the Captain as he thought the pain would go away. Unfortunately, the pain persisted, which resulted in a surgery and the inability to work. The defendants fought liability, claiming the incident never happened and appealed multiple court rulings. Through discovery and key depositions, Terry & Thweatt were able to prove that our client’s employer knew that he had boarded another company’s barge in order to complete his duties and that the defendants had failed to follow their own polices and procedures which would have prevented the incident from occurring. The case was prepared for trial and settled as the trial date neared. Unable to work offshore any longer, this settlement has secured our client’s financial future.
