Federal Court found Rio Tinto unlawfully victimized a CFMEU member, Michael Haylett, who had won a $630,000 damages claim, by standing him down in retaliation.

Mr. Haylett injured his neck at Hail Creek Mine. Rio Tinto admitted negligence. After winning damages, he was stood down. Court found stand down was contrived and in breach of Fair Work Act. Compensation and penalties to be determined later.
