A husband and wife named each other as beneficiaries of their respective IRAs. Following their divorce, neither party updated the beneficiary designations. After the wife passed away, both her estate and her ex-husband made claims to the IRA funds. The case was brought before the Federal District Court of New Hampshire. In a case of first impression, the Court ruled in favor of our client, the plaintiff ex-husband, awarding him the full IRA amount of $149,399.
