Case Details
Vermont Supreme Court affirmed the dismissal of a negligent infliction of emotional distress (NIED) claim, ruling that PTSD alone without concurrent physical injury is not sufficient for NIED, and contact with victim's blood/brain matter was not an 'external force' causing physical injury. The plaintiff suffered emotional trauma and PTSD after witnessing a deadly accident where a utility worker was killed by a truck.
