Case Details

Yijing Chen was crossing the roadway on a green light, while holding the hands of her mother Hong Fen Shen. Nicole Hershel, who was driving a pickup truck, did not see the pedestrians and ran over them. As a result Yijing fractured her leg, and Hong Fen died as a result of her injuries. There were no witnesses to the accident, so Nicole Hershel began to stage the scene to make it look like she was just an innocent bystander. She moved her truck, moved the unconscious Hong Fen, and told the investigating officers that she was just driving by when she saw the two women in distress in the street. Through litigation, it was proven that Hershel caused the collision. At trial, it was proven that she maliciously staged the scene which caused additional emotional distress to Yijing. The jury agreed, and awarded $18,000,000 in damages.
