Case Details

Anderson Larson represented members of the Estate who alleged that the Personal Representative of the Estate had breached fiduciary duties by mismanaging the Estate, conducting an impermissible sale of Estate property, and engaging in transactions with a conflict of interest. The Trial Court removed the Personal Representative and declared the prior sale of the Estate property void.

The Appellate Court affirmed the Trial Court's decision, noting the Personal Representative's failure to observe the required standard of care and breach of fiduciary duty by selling estate property for substantially less than fair market value to his son/business partner.
