Humboldt County Jury returned a verdict of $5 Million against Timber Ridge Assisted Living of McKinleyville LLC and Western Living Concepts, Inc. for wrongful death and elder abuse of 90-year-old Marjorie Fitzpatrick.

Additional Notes

Ms. Fitzpatrick, a dementia patient, escaped through a supposedly locked door, fell, and sustained serious injuries including broken facial bones, a broken wrist, and brain bleed, leading to her death. Plaintiffs alleged facility failed to provide medication, staff were poorly trained, and defendants engaged in a cover-up including destruction of evidence. Verdict included $2.1M for wrongful death, $400k for elder abuse, and $2.5M in punitive damages.
