Secured victory in the Louisiana Supreme Court for the daughter of a NORM victim, establishing that a survival action lawsuit is timely when filed within one year of the plaintiff knowing or reasonably knowing the cause of action. Case: Watkins v. Exxon Mobil Corp., 13-1545 (La. 5/7/14).
Additional Notes
Plaintiff's father died in 1986 from NORM exposure. Plaintiff filed suit in 2010 after becoming aware of the exposure. The Supreme Court agreed with the plaintiff on the timeliness of the survival action.
