The Plaintiff's vehicle was rear-ended by a Tractor Trailer on his way to work. As a result of this incident, Plaintiff had a shoulder surgery, lumbar fusion and a lumbar revision surgery. Defendant’s claim that they were not responsible for the collision and Plaintiff had a pre-existing degenerative back condition and the injuries were not related to this accident. There was no lost earnings claim.
