A police officer and the second at-fault party were in the midst of a vehicle pursuit despite the increasing danger to all persons in the area. The officer did not terminate the pursuit until it was too late. The fleeing vehicle went off-course onto the sidewalk, fatally striking our client who was walking, unshielded.
