DUI
Shanes successfully had breath test results excluded from evidence in his DUI trial. The City of Huntsville's appeal was dismissed by the Court of Criminal Appeals because a DUI is a misdemeanor, and the City cannot appeal a trial judge's decision in such cases.
DUI
Weeks' DUI case was dismissed by the Circuit Court for failure to appear, despite his attempts to contact the clerk's office and inform them of his new address. The Supreme Court directed the Circuit Court to put Weeks’s DUI case on the list for trial.
