Brain Injury

Mr. DiFranco’s client, a passenger in a car chased by an unmarked Evanston police vehicle, suffered multiple injuries including a fractured jaw, fractured vertebrae, a collapsed lung, and permanent brain injuries after the pursued vehicle crashed. The brain injuries resulted in cognitive deficits, memory lapses, and lack of thought organization. Despite the City of Evanston’s denial of willful and wanton conduct and violation of police general order, an $11.2 million verdict was won for the client.

Wrongful Death

Mr. DiFranco’s client’s son was found unresponsive. Park Ridge paramedics were dispatched, observed the teen conscious and breathing, and left without proper examination. Later, the father found his son unconscious and blue. Paramedics were called again, and the son was transported to the hospital but never regained consciousness. The case, initially dismissed by the Illinois Appellate Court, was reversed by the Illinois Supreme Court and ultimately tried. A jury awarded a verdict of $5,187,500.00.

Sexual Assault

An intruder entered Mr. DiFranco’s client’s apartment, allegedly with a master key, and assaulted her. The client suffered facial injuries, post-traumatic stress disorder, and major depression disorder. Investigation revealed that despite the intruder working for the landlord and seven prior incidents of master key access, the landlords failed to change locks or collect outstanding master keys. A $1.5 million jury verdict was won for the client.

Personal Injury

Mr. DiFranco’s client was shot by an armed security guard outside a LaSalle Bank after an argument. The client suffered six gunshot wounds. Despite the bank’s contention of a struggle for the gun and the client’s contributory negligence, a $1.2 million verdict was won for the client.
