Construction Dispute

Ben Novak won summary judgment for the firm’s client, a municipal water authority, in a construction dispute involving claims of unforeseen conditions and project delays. The contractor sought an additional $1.2 million. The Court agreed, and granted summary judgment, holding that the contractor was bound by the terms of the MOU. Therefore, the $1.2 million claim against the firm’s client was dismissed.

Quinn M. McCusker secured an Appellate Division decision confirming the trial court’s Order granting Summary Judgment on behalf of the firm’s client, a subcontractor and the injured Plaintiff’s employer. The Plaintiff obtained a verdict of 100% fault against the general contractor with a damages award of $909,547.00. The Appellate Division entered its opinion in Russo v. O.A. Peterson Constr. Co., 2025 N.J. Super. Unpub. LEXIS 1584 (App. Div. Aug. 21, 2025), siding with McCusker’s client on all issues.

Greg Hirtzel, with the assistance of Ben Novak, had a jury in West Chester, Pa., return a verdict in the gross amount of $10,200 reduced by the assessed comparative negligence of the wife Plaintiff (15%), for a net verdict of $8,670. The jury awarded nothing on the husband Plaintiff’s loss of consortium claim.
