Appellate Work
Successfully argued an appeal concerning a copier lease agreement for his client Canon Financial Services, Inc. (“CFS”). The Superior Court of New Jersey, Appellate Division, affirmed a lower court ruling on behalf of CFS, enforcing a settlement between CFS and one of its customers regarding the return of five copiers or payment for their value.
Land Use Litigation
Attorney Howard Sobel successfully represented residents opposing the construction of a Super Wawa and Tractor Supply Co. development, leading to the Voorhees Planning Board denying the proposal due to issues like insufficient property size, proximity to residential areas, increased traffic, and lack of consideration for bicycle lanes.
Appellate Work
The New Jersey Appellate Division reversed a lower court’s discharge of a court-appointed statutory receiver, finding the receiver failed to comply with statutory obligations for creditor notice, inventory, and accounting. The firm represented Mori Restaurant LLC, the landlord of the leased premises, successfully challenging the discharge. The case was remanded for further proceedings.

The New Jersey Supreme Court upheld the appellate division’s finding that the failure to file a Tort Claims Notice with the proper public entity precluded the ability of the claimant to pursue its personal injury action against a public entity. The firm prevailed in representing the Egg Harbor Township Municipal Utilities Authority.

Defendant's conviction related to possession of marijuana with intent to distribute was overturned by the Appellate Division, finding that the Defendant’s constitutional rights were violated because the arrest was based on a warrant issued by a police officer and not a detached and neutral magistrate.

The 3rd Circuit of the United States Court of Appeals affirmed the lower court’s decision granting summary judgment to the Defendants (represented by the firm) in a case where the Plaintiff did not present evidence of concerted action between Defendants concerning advertisements rejected on policy grounds by a magazine publisher.
