Habeas Corpus Appeal

Pat Brown represented Mr. Roger Brown who appealed a denial of his third habeas petition. The Appellate Court reversed the judgement of the habeas Court on August 26th and remanded with instructions to grant the Petition for Habeas Corpus finding that his prior habeas lawyers were ineffective for not presenting evidence that his original trial counsel did not file a motion to dismiss on Statue of Limitations grounds. The remand mandated that the Petitioner be granted a new trial. This is a rare win for successive habeas claims. Charges: Habeas Corpus Appeal

Disorderly Conduct

Client was charged with a count of Disorderly Conduct arising out of his arrest at an outdoor cookout. Eventually client is offered a Creating a Public Disturbance infraction which would have resulted in no criminal conviction and a nomina fine. Offer rejected and we proceed to trial. Right before the start of jury selection the State amends the charges to add a count of interfering with a police officer (resisting arrest). The conduct occurred one year and a few days before the new charge was filed and when presented it in open court we objected which was denied under the now overruled precedent which allowed charges to be added to a long form provided the facts supporting them were in the arrest warrant affidavit. We then filed a motion citing the recent _State v. Orane C_. decision (SC 20843) which limits the old practice by holding that new charges added to a long form information do not survive the statute of limitations if they allege violations of a different statute, contain different elements, relies on different elements OR exposes the defendant to a greater sentence. The state then proceeded to trial on the remaining and original Disorderly Conduct count and the Court entered a directed verdict in favor of the defendant. Charges: Disorderly Conduct

Sexual Assault

Mr. U was accused of having sexually assaulted his two minor daughters. His civilian wife was his main accuser. We were able to show, through expert testimony and cross-examination of the mother, that she had coached the kids in an effort to stay in on post housing during their pending divorce. Therefore, a Not Guilty was returned and he was able to resume his career in the military. Charges: Sexual Assault of a Minor, 2 counts in violation of Article 120b

Drug Charges

Client was charged with possession with the intent to distribute 5 kilos of cocaine. Client was stopped in an SUV with California plates on Interstate 10 outside of Crowley, Louisiana with cocaine allegedly stored in a false bottom. The charges were dismissed when our firm raised a doubt about her knowledge of the drugs in the vehicle. Charges: Possession with the intent to distribute cocaine
