Zoning Appeal Defense
Successful defense against a zoning appeal that jeopardized our client’s business and property interests. The Superior Court dismissed a hostile zoning appeal after reviewing arguments presented by Joseph Porto and Aaron M. Katz. The client obtained approval for a special permit from their local zoning commission to include a new stormwater runoff management system and drainage outlet, allowing them to expand operations. A third party appealed, claiming inadequate notice, failure to comply with bonding/setback/insurance requirements, and incorrect conclusion on public health regulations. Parrett Porto successfully refuted these claims, demonstrating sufficient notice, arguing that bonding/insurance claims were not raised at the original hearing, and relying on expert testimony for public health regulations. The Superior Court ruled in the client's favor and denied the appeal.
