Wrongful Death

Plaintiff’s decedent, a 15 year old boy, was killed while riding as a passenger on a motorcycle when a car turned in front of them causing the crash. On June 30, 2018, JR came home with his parents and sister after attending church on Sunday and working in the soup kitchen. Several friends had come over for hors d’oeuvres and socializing. A friend of JR’s father had come over on his brand new shiny Harley-Davidson motorcycle. JR asked the father’s friend if he would give him a motorcycle ride as he had never been on one before. The friend told him to ask his parents for permission. JR asked his dad and his dad told him to ask his mother and he did. After some discussion, both parents agreed. It was a sunny day about 3 p.m. JR rode on the back of the cycle behind the driver, dad’s friend. After about an hour, the parents wondered where they had gone. Right at that moment the doorbell rang. A police officer was standing at the door. He told the parents to come with him as there had been a very bad accident. The officer rushed the parents to the emergency room of the hospital where parents saw their son unconscious and under life support. The parents were told that as the motorcycle came down a two-lane country road, CR, who was working for her employer at the time, turned left in front of them whereupon the cycle could not stop and collided with her passenger side back door of the car CR was driving and owned by her employer. Both the driver of the motorcycle and JR were propelled over the car coming to lie on the pavement. The driver received major injuries. JR never regained consciousness and died two days later of massive injuries. The distraught parents felt guilt by allowing JR to go on the motorcycle ride. Each parent blamed the other for their son’s death and required both psychiatric counseling and grief counseling.

Traumatic Brain Injury

On Feb. 1, 2016, plaintiff TM, who was 7 years old, was riding with JD, his 10-yearold classmate, in a van driven by JD’s mother, “Defendant One.” Both TM and JD were riding in the rear seat with their seatbelts on. As the van entered an intersection that was controlled by a stoplight, an employee of a contracting company, “Defendant Two,” collided with Defendant One while driving 35 mph. The collision caused Defendant One’s van to strike a telephone pole. The impact was violent enough that, despite wearing seatbelts, both children were ejected through the rear glass window of the van. Both children landed on the pavement of the roadway. JD died at the scene. TM remained unconscious and was transported to the hospital; he later regained consciousness several hours later. Both Defendant One and Defendant Two alleged that the other had run the red light and caused the collision. Liability was heavily contested. Numerous depositions were taken during discovery. An eyewitness who saw Defendant Two run through the red light and caused the collision was identified. The witness had relocated out of state with no forwarding address. A nationwide search for him was initiated. This witness was finally located in San Diego. The defendants strongly contested TM’s traumatic brain injury, alleging that he previously had a learning disability, was ADD and doing poorly in school. The parties agreed to mediate with no admission of liability from either defendant. The mediation started at 10:00 a.m. and lasted until 8:00 p.m., whereupon agreement was reached with Defendant Two to pay $2 million plus mediation costs.

School Bus Accident

A school bus driver was in route to school to pick up children and return them home. While traveling 37mph, according to the bus GPS, she was near the peak of the bridge approaching a limo that had come to a stop due to traffic. The bus driver was looking at a rain cloud in the sky when the bus rammed the limo with such impact that the nuts and bolts holding a captain’s chair to the frame were sheared off, releasing the chair from the frame. The radio in the dash was ejected out of the dash onto the front seat. The limo driver and three passengers were all injured. The plaintiff herein was a 68-year-old female who had retired. Her neck was broken. She was transported to the emergency room where she had immediate surgery. This surgery was not successful. The plaintiff underwent a second surgery the following week with favorable results. The plaintiff was affected emotionally, psychologically and medically. Several family members, businessmen and friends testified at the mediation as “before and after” witnesses. The plaintiff has made a remarkable recovery.
