Case Details
The at-fault Defendant rear-ended our client, causing aggravation of a pre-existing chiari malformation (structural cerebellum malformation). The client required a craniotomy as part of their medical treatment. Attorneys had to prove, through expert medical testimony, that the pre-existing chiari malformation was indeed aggravated by the collision. Challenges included an adverse expert medical opinion that the wreck did not cause the injury aggravation, which was reversed after a four-hour deposition.
