The client required a craniotomy as part of their medical treatment. Attorneys had to prove, through expert medical testimony, that the pre-existing chiari malformation was indeed aggravated by the collision. Challenges included an adverse expert medical opinion that the wreck did not cause the injury aggravation, which was reversed after a four-hour deposition.

The defendant fell asleep at the wheel and veered off the road, striking the client on the side of the road while he was helping a friend load car seats into his car. Injuries included multiple fractures, treatment for 1 year, and medical bills of $200k. The client’s insurance coverage was only $20,000. The insurance company failed to provide proper defense for the defendant, which allowed the plaintiff to sue the insurance company for bad faith.

Wrongful Death

The defendant ran a stop sign, claiming they never saw our client’s car. Unfortunately, the client was not wearing a seat belt, so they were ejected from the vehicle. As a result, the client suffered multiple broken bones and a severe head injury. They were on life support for some months before their eventual death. Attorneys obtained nearby surveillance camera footage, which captured the accident and proved that the client was not speeding and that the defendant ran a stop sign. Challenges included the defendant completely denying liability and claiming that the client was speeding, and that had the client worn a seatbelt, they would have only suffered minor injuries. Further, our client tested positive for alcohol and cocaine at the time of the crash and was driving under a suspended license. Ultimately, we proved that the defendant had actually run the stop sign that caused the wreck.
