The Fifth District Court of Appeals overruled the Muskingum County Court of Common Pleas decision to deny Mr. Gheen’s Motion for Rule 29 Motion for Acquittal at the close of trial. The Motion made on Mr. Gheen’s behalf alleged that the trial court and the prosecutor for the State of Ohio failed to meet its burden in finding the Defendant committed the crime for which he was charged - Perjury, a third degree felony.
