Criminal Defense

The Fifth District Court of Appeals overruled the Muskingum County Court of Common Pleas decision to deny Mr. Gheen’s Motion for Rule 29 Motion for Acquittal at the close of trial. The Motion made on Mr. Gheen’s behalf alleged that the trial court and the prosecutor for the State of Ohio failed to meet its burden in finding the Defendant committed the crime for which he was charged - Perjury, a third degree felony.

Workers' Compensation

Client filed for Permanent Total Disability benefits due to severe injuries. The Industrial Commission denied the request, but the Court of Appeals reversed and remanded for another hearing.

Client’s Temporary Total compensation was terminated by the Industrial Commission. The Court of Appeals reversed and remanded the case for another hearing, finding medical evidence insufficient to stop compensation.

A jury verdict was obtained establishing that his pre-existing back issues had been aggravated by the industrial accident, which was upheld by the Eleventh District Court of Appeals.
