Case Details
Plaintiff, a machinist, sustained acute hearing loss, pain in both ears, severe headaches, and permanent tinnitus and hypercausis after a locomotive horn was inadvertently sounded in a repair shop. The horn blast was due to a co-worker placing a spotter cable on top of the locomotive console, activating the horn.

Plaintiff established that a history of such horn blasts existed.
