Washington State Court of Appeals ruled that the foreclosure of a Condominium Owners Association (COA) assessment lien could eliminate a prior mortgage lien.

Additional Notes

The COA, as the successful bidder at the foreclosure sale, obtained title to the unit free and clear of the prior mortgage, even if the mortgage was larger than the unit's present value. Case: Summer Hill Village Home Owners Association v. Roughley.
