Traffic Violation
A Kentucky licensed RN was charged with Leaving the Scene of an Accident, a Class A Misdemeanor that she would have to report to her licensing board. Further, if convicted, her driver’s license would be automatically suspended for six months. Attorney secured for her an amendment to a nonmoving traffic violation, thus keep her driving license as well as avoiding costly hearings with the Nursing board.
Drug Offenses
Our client was a young man with no criminal record, who held a good job. Unfortunately, his roommate was involved in narcotic activity that our client was unaware of. On the day of his arrest, the police received information that a wanted individual was at our client’s home. Our client was asleep, because he had to work in the morning. However, his roommate had several people at the house to watch a ballgame, including the person that was wanted by the police. A group of officers arrived at the house looking for the wanted individual. The police claim that as they walked up to the house, they could smell marijuana, even though there were no windows open and it was a cold night. They ordered everyone out of the house, including our client. At that point, they entered the house without a warrant to conduct a “safety sweep”. While inside the residence, they saw contraband that they used to obtain a search warrant. We filed a motion challenging the legality of the search, claiming that the police did not have the right to enter the home without a warrant. The circuit judge ultimately agreed, and a felony that carried 5 to 10 years against our client was dismissed. Because we successfully challenged the search, our client will not lose his job, and the charges against him will be expunged.
Criminal Defense
Our client was facing up to 90 days in jail for the misdemeanor offense of Menacing (KRS 508.050). A college student with a bright future, she was initially denied entry into a diversion program. Our firm was retained and investigated the circumstances surrounding the case. As a result, we were able to persuade the prosecution to allow her to complete a diversion program, the offense has subsequently been dismissed and expunged, and our client’s future is still bright. We also were able to keep the offense from being brought as a campus discipline issue.
Criminal Defense
Our client was charged with Impersonating a Peace Officer. Having never been in any trouble before the client was obviously scared, worried about losing his job, and needed help. The criminal defense team at Baldani, Rowland & Richardson got to work immediately on his case. After interviewing the client and hearing his side of things, it became obvious that his actions did not warrant a felony conviction. Attorney Brandi Lewis was able to negotiate a plea deal which amended the case to a simple violation and required the client to take an online class. After completing the online class, the case will be dismissed and expunged from his record. No jail time. Nothing on his record.
Theft
F.H. was charged with Theft of a Firearm, Class D Felony, in Lexington, KY. F.H. was facing the possibility of five (5) years in prison and being labeled as a convicted felon for the rest of her life. After seven months of attempted negotiations failed, F.H. put her trust in Baldani Law Group to take her case to a jury trial.After a long day of trial, the jury returned a verdict of “NOT GUILTY”. F.H. was able to walk out of the courtroom free and without the stigma of being a convicted felon.
Criminal Defense
A husband and wife were charged with multiple counts of Unlawful Transaction with a Minor (first and second degree) as well as Cultivation of Marijuana and Possession of Drug Paraphernalia. All felony charges were amended to misdemeanors. Both clients received a two year probation sentence with fifteen days jail time. Both clients also received the privilege of work release. The prosecution agreed not to object to expungement of the charges five years after completion of the sentence. One defendant was a licensed professional. As a result of the amendment to the charge she was not required to report the offense to her licensing board.
