Defamation Lawsuit

Capozzi Adler, P.C., and Lisa Basial, Esquire represented Bartlett, Traynor & London, LLC, and John Traynor in a defamation lawsuit against YC News, Shawn Cooper, Nikolaos Hatziefstathiou and Travis Wilbur. The Court awarded 4.7 million in damages, including $275,000 in damages to John Traynor personally. The award is one of the largest awards ever seen in a defamation case in Dauphin County, PA.

Medicaid Certification Appeal

Successfully represented clients in Millcreek Manor v. Department of Public Welfare, resulting in the Court vacating an Administrative Law Judge’s opinion denying Medicaid certification of additional licensed nursing home beds and remanding the case for a full de novo review on the merits.

Healthcare Regulatory Litigation

Successfully argued Christ the King Manor v. Secretary, Department of Health and Human Services in the Third Circuit Court of Appeals, where a DHS State Plan amendment imposing the Budget Adjustment Factor on nursing facility providers was declared invalid.

ERISA Class Action

Lead attorney for plaintiffs in an ERISA case that resulted in a seminal U.S. Supreme Court decision, Fifth Third Bancorp, et al. v. Dudenhoeffer, et al., clarifying fiduciary duties to pension plan participants.
