Successfully defended a motor vehicle accident case brought by a husband and wife against a meat delivery company and their truck driver, tried on damages only. Plaintiffs were rear-ended and claimed nearly $180,000 for medical treatment and over $500,000 in total damages.

Medical Negligence

Obtained summary judgment for a hospital in a case involving alleged sexual abuse by a male nurse against a patient in the hospital’s emergency department.

Appellate Practice

Represented Louisville Metro in a matter stemming from a motor vehicle accident involving an off-duty police officer operating a police take-home vehicle. The Court of Appeals determined that the Claims Against Local Governments Act (CALGA) does not obligate local governments to defend or indemnify employees for actions outside the scope of their employment.

Appellate Practice

Defended an award of summary judgment to clients Corizon, Inc. and two employed nurses in a 42 U.S.C. § 1983 “deliberate indifference” case before the United States Court of Appeal for the Sixth Circuit. Plaintiff claimed her brother died of a drug overdose while in custody due to neglect and deliberate indifference.

Appellate Practice

Drafted and filed an Amicus Curiae brief on behalf of the Kentucky Defense Counsel in an appeal to the Supreme Court of Kentucky regarding an attempt to expand third-party bad faith law in Kentucky. The case arose from a medical malpractice claim.

Appellate Practice

Successfully pursued an appeal of a Court of Appeals decision requiring Encompass to provide coverage for injuries arising from the Plaintiff’s use of a motorcycle insured with a different company. Kentucky’s Supreme Court reversed the Court of Appeals.
