The Supreme Court of Iowa issued a unanimous decision in favor of Weil-McLain, upholding the Court of Appeals’ reversal of the trial court's verdict and remanding the case for a new trial.

Motor Vehicle Accident

Secured a significant victory in Oakland County, Michigan. Plaintiff's counsel demanded $1.25 million before trial, and sought $3.7 million at trial for multiple injuries from a motor vehicle accident. The jury awarded damages solely for a left knee injury, amounting to less than 2% of the initial demand. The economic claim was dismissed via directed verdict.

Successful on appeal after client’s Motion to Set Aside the Jury Verdict had earlier been granted in a New York World Trade Center Memorial site construction injury action. Plaintiff, a construction laborer, was originally awarded $1,825,000. The appellate court ordered a new trial solely on the issues of damages unless the parties could stipulate to an award of $900,000.
