Breach of Contract
The Court of Appeals affirmed the jury verdict and award of costs in Chelsey Burns’ executive compensation breach of contract case that went to trial in January 2012, resulting in final payment to her clients of $2.4 million.

Auto Accident
Received a favorable decision on a restitution case in Adams County Court. The case involved a three vehicle collision. The carrier settled with one of the claimants for policy limits. That same claimant then sought additional restitution as a victim through a criminal case. The Court held an unopposed restitution hearing, and entered restitution against the insured in the amount of $20,444.70, plus interest. Mr. Stokan obtained an order offsetting the entire amount of restitution plus interest that had been ordered against the insured.

Prevailed on a motion to dismiss in a case involving a faulty septic system. Not only was Diana’s motion to dismiss granted, but she was also awarded attorneys’ fees and costs. All told, the Court awarded Diana $9,722.93 in combined fees and costs.

Auto Accident
Tried an auto accident case in Denver District Court with admitted liability. Plaintiff alleged that Defendant ran a red light and was negligent in causing the collision and that as a result of the accident Plaintiff suffered injuries. Defendant disputed that the accident caused the Plaintiff’s injuries and disputed the extent of her injuries. The jury awarded the Plaintiff $1,000.
Construction Defect
Obtained a favorable ruling following a seven-day construction defect Arbitration hearing. White and Steele’s client was a general contractor for the construction of a multimillion-dollar home. The claimants alleged that the client's construction of the home was defective, done negligently, and in breach of the construction contract. The damages sought by the claimants exceeded $6 million. The Arbitrator rejected the contention that the construction was defective and that the house needed to be rebuilt. The Arbitrator ruled that the claimants were not entitled to recovery from the general contractor for defective construction or breach of the contract.
Worker's Compensation
Received a favorable decision in a full contest Worker's Compensation claim. The Administrative Law Judge agreed that the claimant’s violation of the employer’s instruction, specifically not to pursue shoplifters outside the store, limited the sphere of employment and severed the causal connection between the employment and the injury.
