James D., a chronic diabetic, was admitted to a hospital for repair of an open wound on his left foot which was not healing properly. James expected that his left foot would eventually have to be amputated. While he was anesthetized for the surgery, his right foot (which was in fine condition and not intended to be the subject of any surgery) was somehow injured. Due to his diabetes, the minor injury eventually worsened, requiring the amputation of James’ right foot below the knee.
