On January 1, 2006, Jacine Sarmiento was killed and her daughter Athena Rose Sarmiento was injured when a tree fell onto their vehicle on S.R. 1 near Struve Road. Plaintiffs contended the roadway was in a known dangerous condition due to unhealthy trees, and the defendant State of California allegedly knew of the hazard but failed to fix it.
