Our client was a resident in a Group Home for the disabled. He fell down a flight of stairs due to the negligence of the staff at the residence and sustained a fractured neck. Four months later he died as a result of his injuries. The decedent had no economic loss or dependents, so defendant argued that there was not a wrongful death claim and that the decedent had limited pain and suffering. Our firm negotiated a settlement at mediation for the Estate and fought vigorously on behalf of the estate to get decedent’s Medicaid lien reduced down.
