Case Details

An eighteen year old disabled residential student of a non-profit school jumped approximately 30 feet from the roof of the school building in an apparent attempt to kill herself. The student suffered multiple mid-back fractures from the fall, requiring surgery to stabilize her spine with a titanium surgical mesh cage, plate, and screws.

Additional Notes

The case settled at a mediation after showing school employees failed to meet the standard of care for keeping a student with a propensity for self-harm safe. The staff member was negligent for allowing the student to be more than an arm’s length away, and the school was negligent for failing to block access to the fire escape stairs. The settlement was used to purchase an annuity for the client. The case was significant for defeating the “charitable immunity defense” which limits recovery against Massachusetts non-profit organizations.
