Williams, a conductor for BNSF, suffered a torn medial meniscus in his right knee requiring two arthroscopic surgeries, and was unable to return to work, when he slipped on large mainline ballast while descending a locomotive ladder after his 12 hours on duty had expired and the train was stopped in an unsafe location.

BNSF directed the train to stop where only large mainline ballast was available on a slope, despite being able to stop in a safer location. The railroad argued the ballast was safe and Mr. Williams failed to use a three-point stance.
