Case Details

Our clients were the parents of a 26-year-old, severely autistic young man who was placed into a home allegedly designed to provide skilled and compassionate care to the disabled. One evening, a nurse/caregiver lost his patience and started punching and kicking our client, causing injury to his eye as well as emotional trauma. We sued the operator of the home and the staff member. After they denied liability, we deposed the principals of the company and found the level of care and supervision was substandard and that the homes were understaffed. We also discovered a video of the incident, which showed the staff member lost control and did not comply with safety protocols. The case resolved shortly thereafter, and the money went towards setting up a fund for the son to assist with his care.
