Snow-removal co. failed to clear parking lot, plaintiff alleged. Plaintiff D.G., 51, a truck driver, slipped on a patch of ice in the parking lot of a trucking facility. He sustained injuries to his back, head, and neck, including a brain hemorrhage, concussion, palsy of his fourth cranial nerve, and herniated discs requiring surgery. He also developed post-concussion syndrome affecting cognitive ability and causing emotional distress. Defendant H & R, the English Landscape Gardeners Ltd., failed to timely procure new counsel, leading to default judgment. Judge Thomas Whelan determined damages.
