Disabled woman, bound to a wheelchair due to cerebral palsy, suffered multiple fractures in both legs due to an unexpected uplift from one slab of sidewalk to the next. The sidewalk had an abrupt vertical lift of 1 5/16 inches. The City contended the condition was not reported and obvious, and that the client's friend was negligent. Evidence showed a tree bordering the sidewalk caused the displacement, and the City had opportunity to identify the defect.
