The assailant was convicted and is currently incarcerated. Prior to the commencement of this suit, the defendant and his wife had divorced and the wife had obtained title to the marital premises. The plaintiff brought this action in the Chancery Division, obtaining an order prohibiting any further transfer of the property to any third party. The infant plaintiff contended that she sustained a severe emotional injury for which she receiving therapy. The evidence would have disclosed that the prognosis is favorable because of a very supporting home environment. The plaintiff obtained a default judgment against the molester for $750,000.
